Public Protection privacy notice

The Council’s Public Protection Service consists of: 

Environmental Health: Public Health and regulatory controls on Food Hygiene, Pollution, Private Sector Housing, workplace health and safety, waste enforcement including acting on complaints and intelligence in any of these areas. 

Licensing: The determination and enforcement of licences in a wide range of circumstances including taxi and private hire, alcohol, entertainment, animal welfare and street trading. 

Community Safety: Managing the Council’s partnership obligations as part of the Community Safety Partnership, the handling of complaints of neighbourhood dispute and Anti-Social Behaviour, and the operation of the Epsom town centre CCTV system. 

What we need 

General Information as appropriate: 

  • Name, address, telephone number, email address 
  • Unique identifiers (NI number or similar) 
  • Imagery (photographs & video footage) 
  • Land ownership and occupier details 

Specific Service Data: 

  • Accident notifications: Injured parties' details, witness information, circumstances 
  • Environmental enforcement: Offender details, physical description, offences committed, vulnerabilities. 
  • Licensing applications: Name, address, date of birth, nationality, criminal record, medical history, vehicle details, insurance, driving licences, payment information (not retained). 
  • Environmental complaints: Complainant and alleged perpetrator details, witness information, noise/video recordings, CCTV footage 
  • Infectious diseases: Medical conditions, employment details, travel history, family contacts, sample results 
  • Housing related information: Details of tenancy, landlord, financial information 
  • Food safety: Business operator details, premises information 
  • Community Safety: CCTV Video imagery, victim and offender details, description of allegations, vulnerability data, medical summary information. 

Additionally, certain legislation gives us powers to obtain this information from third parties and hold them for the purposes of investigating a criminal matter.

  • To comply with statutory duties under environmental and licensing legislation 
  • To maintain public registers and records 
  • To prevent and detect regulatory offences

How long we keep it 

  • Active licences: Duration of licence plus 6 years 
  • Inspection records: 6 years after last inspection 
  • Enforcement actions: 6 years after case closure 
  • Serious incidents: Up to 20 years 
  • Public registers: Permanently where required by law

Public Registers: We maintain statutory public registers including licensed premises, drivers/vehicles/operators/Houses in Multiple Occupation, food businesses, gambling licences, and environmental permits. These contain only information required to be public. 

Lawful basis for processing Legal obligation under a variety of legislation not restricted to the Licensing Act 2003, Local Government Miscellaneous Provisions Act 1976, Food Hygiene (England), Regulations 2013, Health and Safety at Work etc Act 1974, Housing Act 2004, Environmental Permitting Regulations, Anti-social Behaviour, Crime and Policing Act 2014.
